LEGAL UPDATE

IDAHO Senate Bill 1173 affirms that citizens who are otherwise justified to use physical force in self-defense situations have the option of displaying a firearm or verbally informing an assailant that they have a firearm. This empowers law-abiding citizens to defend themselves and their loved ones by attempting to dissuade threats before having to use deadly force. Nothing in this bill changes the standards for justified self-defense or mandates that displaying or informing of firearms must precede using deadly force in justified self-defense. The Idaho House voted 60-10 to pass Senate Bill 1173, after the Senate sent it over last week. It now goes to Governor Brad Little’s desk for his signature. While this bill is good news for the pro-self defense crowd, I still do not advise brandishing a firearm as a defensive tactic. Once the gun comes out, you are in lethal-force territory. This bill offers some protection in those circumstances where the act of drawing the firearm discourages an attacker, who might then seek to have the defender charged with "brandishing." Even in these situations, notifying the police IMMEDIATELY is crucial to being able to invoke "self defense."

NEW MEXICO - There are 6 days remaining in the current legislative session.
  • Red Flag Gun Law Proposal: Efforts to amend the existing "Extreme Risk Firearm Protection" order act are currently stalled in the Senate Judiciary Committee. The proposed changes aim to allow law enforcement to file petitions based on their official duties.
  • SB 279 - Gas-Operated Semiautomatic Firearms Exclusion Act: This controversial bill seeks to ban the sale, transfer, and possession of most gas-operated semiautomatic firearms and large-capacity magazines. It also includes a registration requirement for existing firearms. The bill has sparked significant debate, with proponents citing public safety and opponents raising constitutional concerns. On March 8, 2025, the SJC reported the bill with a "Do Not Pass" recommendation but included a "Do Pass" recommendation for a committee substitution. The bill is now pending further review by the Senate Finance Committee TAKE ACTION HERE
  • SB 318 - aims to make it easier to sue firearms dealers and manufacturers. This bill creates a special cause of action under the state's Unfair Practices Act. It allows private individuals and the Attorney General to file lawsuits against firearms manufacturers, distributors, and online marketplaces if their products are used in crimes, claiming they should have reasonably foreseen the harm caused. The bill has sparked significant debate, as it violates the federal Protection of Lawful Commerce in Arms Act (PLCAA), which generally shields gun manufacturers and dealers from liability for crimes committed with their products. Passing this act would allow the state to sue every FFL in New Mexico out of existence. It has already passed the Senate Taxation, Business, and Transportation Committee with a "Do Pass" recommendation and is now awaiting review by the Senate Judiciary Committee. While it has gained some momentum, its fate depends on the deliberations in the Judiciary Committee and any subsequent votes in the Senate and House.
